All marriage certificates issued by the Federal Ministry of Interior Marriage Registries; Ikoyi and other Marriage Registries other than the Local Government Council Registries Nationwide since 2004 are unconstitutional and void base on the judgement of Coran Olomojobi read in SUIT NO FHC/L/ CS/870/2002.
BY the decision of Hon. Justice Chuka Obiozor of the Federal High Court Lagos delivered on the 30th day of April 2018 in SUIT NO. FHC /L/CS/1760/16, the court affirmed that the 1999 CFRN empowers Local Government Council Marriage Registries to register all types of marriages to the exclusion of the Federal Ministry of Interior Affairs Ikoyi Marriage Registry or any other registry in Nigeria.
The court advised that "nobody is above the law".
It therefore strike out the Suit No. FHC/L/CS/1760/16 on grounds that the matter has been earlier decided in the above mentioned judgement by Justice Olomojobi.
Justice Obiozor adviced all parties to comply with the earlier judgement of the court given since 2004 by not interfering with the functions of the Local Government to register all types of Marriages.
